Please read the following terms and conditions before registering on, accessing or using the website www.akoirah.com (“this Website”) or any similar platform (hereinafter collectively called the Platform). This Website are owned and operated by Akoirah Diamonds Private Limited.

The documents and related graphics published on this Platform may include technical inaccuracies or typographical errors. Akoirah Diamonds Private Limited reserves the right to make changes and corrections to the content on the Platform at any time without prior notice. We, Akoirah Diamonds Private Limited and/or our designated affiliates (jointly “Akoirah”) provide the Platform features to you, the User/Member/Registered Member/Customer subject to your acceptance of the following Terms and Conditions of Access and Use, constituting an agreement between us (“Agreement”). Akoirah operates a business-to-consumer (B2C) model for the sale of lab-grown diamond jewellery through its Platform and physical retail stores. “Product” shall mean lab-grown diamond jewellery or any other form as maybe introduced by Akoirah. If you continue to use the Platform or communicate with us, you will be deemed to have accepted these Terms and Conditions of Access and Use. Please read these Terms and Conditions of Access and Use carefully. In addition, when you use any current or future Akoirah service or products, you will also be subject to the guidelines, terms and agreements applicable to such service or business (“Specific Terms”). If the Terms and Conditions of Access and Use are expressly inconsistent with such Specific Terms, the Specific Terms will prevail.

Akoirah may revise these Terms and Conditions of Access and Use and Specific Terms from time to time and at any time, without notice to you. If you do not agree to be bound by these Terms and Conditions of Access and Use, as modified from time to time, you should refrain from using the Platform immediately. The Terms and Conditions of Access and Use and Specific Terms shall be hereinafter collectively referred to as “Terms and Conditions”.

The section titles in these Terms and Conditions are for convenience only and have no legal effect.

Acceptance of Disclaimers and Exclusions

You acknowledge that the disclaimers and exclusions of liability in these Terms and Conditions represent a fair and reasonable allocation of the risks and benefits of the Agreement between you and us, taking all the relevant factors into consideration. You agree that these disclaimers and limitations shall be enforceable to the fullest extent permitted by applicable law. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Platform or these Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Business Rules

The Platform shall facilitate purchase and sale of lab grown diamond jewellery with each of its specific users (such users are referred to as “Registered Members”). The Product can be bought and returned online using the Platform’s buying / return option. The value of the Product is in INR terms and excludes GST and other applicable taxes. Both Buy and Sell prices of the Product will be quoted exclusive of GST. Akoirah shall raise e-invoices for the Product sold.

Copyright

All content included on the Platform such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Akoirah or its content suppliers and is protected by international copyright laws. All software used on this Platform is the property of Akoirah or its software suppliers, and is protected by international copyright laws. The content of the Platform cannot be copied, reproduced, republished, uploaded, posted, transmitted or distributed for any non-personal use without the prior written approval of Akoirah.

Graphics, logos, page headers, button icons, scripts, and service names contained in or features on the Platform are trademarks or trade dress of Akoirah. Akoirah’s trademarks may not be used in connection with any other product or service, in any manner that is likely to cause confusion, disparage or discredit regarding Akoirah and its products and services. All trademarks not owned by Akoirah that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Akoirah.

Disclaimer of Warranties

The Platform and all information, content, materials, products (including software) and services included on or otherwise made available to you through the Platform are provided by Akoirah on “as is” and “as available” basis, unless otherwise specified in writing. Akoirah makes no representations or warranties of any kind, express or implied, as to the operation of this Platform or the information, content, materials, products (including software) or services included on or otherwise made available to you through this Platform, unless otherwise specified in writing. You expressly agree that your use of this Platform is at your sole risk. To the full extent permissible by applicable law, Akoirah disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Akoirah does not warrant that this Platform; information, content, materials, products (including software) or services included on or otherwise made available to you through this site; their servers; or electronic communications sent from Akoirah are free of viruses or other harmful components. Akoirah will not be liable for any damages of any kind arising from the use of this site or from any information, content, materials, products (including software) or services included on or otherwise made available to you through this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified expressly in writing.

Akoirah shall not be liable for any unauthorized credit/debit card, or any other payment instrument that is being used for making any transaction on the Platform and shall have no liability either to the true holder of any credit/debit card or the payment instrument or to the concerned bank for any unauthorized/fraudulent use of the credit/debit card or the payment instrument. In no event shall Akoirah be held liable to the true holder of the payment instrument or to the concerned bank for processing and fulfilling its obligations upon realization of purchase amount towards such fraudulent transaction.

Disputes

Any dispute or claim relating in any way to your visit to the Platform or to products or services sold or distributed by Akoirah or through the Platform will be resolved first by arbitration. The Indian Arbitration and Conciliation Act of 1996 and including its amendments thereof applies to this agreement. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim in detail to our address available on the Platform. The arbitration will be conducted in Mumbai by an independent arbitrator appointed by Akoirah. The costs of arbitration proceedings will be borne by the party so instructed by the arbitrator, on merits of the case. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

Electronic Communications

By using this Website or any other related platform, and/or by procuring quotations or engaging with services therein, you expressly authorize Akoirah and its authorized partners to contact you via calls, emails, SMS, WhatsApp, RCS (Rich Communication Services), push notifications, or any other communication channels, on the contact details you have provided.

This communication may include, but is not limited to, transactional updates, service-related messages, promotional offers, marketing content, reminders, and other relevant information related to the products and services offered by Akoirah.

This consent shall remain valid and enforceable regardless of your registration with the National Do Not Call Registry (NDNC) or any other similar preferences set by you under any applicable law or regulation. By continuing to use our services, you acknowledge and accept this communication policy.

Additionally, your consent may be recorded and shared with platform providers (such as Meta) or relevant third parties, solely for audit, compliance, or dispute resolution purposes in case of platform-related account restrictions.

Cookies

The Platform may use cookies and similar tracking technologies to enhance user experience, analyse website traffic, and improve services. By using the Platform, you consent to the use of cookies in accordance with the Cookie Policy available on the Platform.

Equipment

You shall procure and maintain all communication and other equipment necessary to access the Platform and the costs of any such equipment and communication connections or use, including any applicable taxes, shall be borne solely by you. You are responsible for operating your own equipment used to access the Platform.

Financial Transactions and Taxes

If you wish to make any financial transactions on the Platform, including paying for products or services, you may be asked for payment information. You agree that all information you provide is accurate, complete and current and that you will pay all charges owed, including any applicable taxes. You agree that you are solely responsible for any personal income reporting and tax payments required of you by applicable government authorities.

Governing Law and Jurisdiction

By visiting the Platform, you agree to be bound by the applicable Indian laws and State laws, including those pertaining to taxation. This Agreement has been executed and delivered in India, and its interpretations, validity and performance shall be construed and enforced in accordance with the laws of the Republic of India, without regard to principles of conflict of laws, and shall be subject to the exclusive jurisdiction of courts at Mumbai, India.

Indemnification

You agree to indemnify, defend and hold Akoirah harmless from all claims, damages and expenses (including attorney’s fees) made by any third party arising out of your content, your use of the Platform, your connection to the Platform, your violation of this Agreement, Akoirah’s Terms and Conditions.

Independent Investigation

You acknowledge that you have read these Terms and Conditions of Access and Use and agree to them in the entirety. You understand that we may at any time (directly or indirectly) solicit member referrals on terms that may differ from those contained in these Terms and Conditions of Access and Use. You have independently evaluated the desirability of associating with the Platform or of participating in its programs or of availing its services and/or products, and are not relying on any representation, guarantee or statements other than as set forth in these Terms and Conditions of Access and Use.

License and Site Access

Akoirah grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Akoirah. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Akoirah. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Akoirah without its express written consent. You may not use any Meta tags or any other “hidden text” utilizing Akoirah’s name or trademarks without the express written consent of Akoirah. Any unauthorized use terminates the permission or license granted by Akoirah. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the Platform so long as the link does not portray Akoirah, or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Akoirah logo or other proprietary graphic or trademark as part of the link without the express written permission.

Limitation of Liability

You expressly agree that use of the Platform is at your sole risk. While Akoirah will take all reasonable precautions to ensure uninterrupted and error-free operations, your access and use of the Platform is at your sole risk. The service is provided on an “as is” and “as available” basis. We and our licensors, suppliers, vendors, parent, holding, subsidiary and related companies, affiliates, officers, agents and employees expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall Akoirah be liable for any direct, indirect, incidental, special, punitive, consequential damages, or any damages whatsoever, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or the inability to use our services or access content,
• The cost of procurement of substitute goods and services resulting from transactions entered into through or from the Platform,
• The unauthorized access to or alterations of your transmissions or data,
• Statements or conduct of any third party on the service, or
• Any other matter relating to any service or product offered, delivered or agreed to be delivered, even if Akoirah has been advised of the possibility of damages.

Other Businesses

For your convenience, the Platform may provide links to the sites of affiliated companies and certain other businesses, which may not be in our control. You acknowledge that Akoirah does not endorse these linked sites (even if they pop up in a frame) or any links contained in these linked sites. We are not responsible for examining or evaluating, and we do not warrant the offerings of any of these businesses or individuals or the content of their website. Akoirah does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

Patents

One or more patents owned by Akoirah may apply to the Platform and to the features and services accessible via the Platform. Portions of the Platform may operate under license of one or more patents.

Pricing

Except where noted otherwise, the prices displayed for products/services on the Platform represents the value of the respective product/service. For certain transactions, you shall bear fees and charges in addition to payment for prices displayed on the Platform. Such additional fees and charges shall be as are stated on the Platform. Please pay attention to the details of your transactions, because your total price for a transaction may include taxes, fees and shipping costs, which you are responsible for paying.

With respect to services provided or products sold by Akoirah, we cannot confirm the cost of a service or the price of a product until you order. Despite our best efforts, a small number of the product or service in our catalogue may be mispriced. If a product or service’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel the respective order and notify you of such cancellation.

KYC Consent

The Customer agrees and authorizes Akoirah to use his/her KYC for the purchase of any Products/Services offered / facilitated by Akoirah through the Platform or its branches from time to time without requiring any further consent of the respective customer w.r.t such usage.

Product/Service Descriptions

Akoirah attempts to be as accurate as possible with respect to its product and services. However, Akoirah does not warrant that product or service descriptions or other content of this Platform is accurate, complete, reliable, current, or error-free. If a product offered by Akoirah is not as described, your sole remedy is to return it in unused condition for a replacement under the provisions of our Replacement Policy.

The photographs and impressions displayed on the platform are for reference only and are not to scale. The size, colour, finish, lustre, weight and other visual parameters of the actual product may differ to an extent from the photographs and impressions, information displayed on the Platform. The Products shall be considered to have a defect in quality if they have an inherent material or manufacturing defect. Minor deviations from the image shown and information displayed on the Platform shall not qualify as a defect. Akoirah shall not be liable for any action on this account.

Reviews, Comments, Communications, and other Content

You may post reviews, comments, photos, and other content and submit suggestions, ideas, comments, questions, or other information to the Platform, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of spam. You may not use a false e-mail address or mobile number, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Akoirah does not regularly review posted content, but reserves the right (but has no obligation) to remove or edit such content, at its sole discretion.

If you do post content or submit material, and unless we indicate otherwise, you grant Akoirah a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Akoirah and its sub-licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these Terms and Conditions and will not cause injury to any person or entity; and that you will indemnify Akoirah for all claims resulting from content you supply. Akoirah has the right but not the obligation to monitor and edit or remove any activity or content. Akoirah takes no responsibility and assumes no liability for any content posted by you or any third party.

Platform Terms and Conditions, Modification, and Severability

Please review our other policies posted on this site. These policies also govern your visit to the Platform. We reserve the right to make changes to our site, policies, and these Terms and Conditions of Access and Use at any time. If any of these Terms and Conditions of Access and Use is deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall be modified so as to give effect to the economic intent of such impugned provision, and shall not affect the validity and enforceability of the remaining Terms and Conditions of Access and Use.

Void Where Prohibited

Although the Platform is accessible worldwide, not all products or services discussed or referenced on the Platform are available to all persons or in all geographic locations or jurisdictions. The Platform reserves the right to limit the provision of any product or service to any person, geographic area or jurisdiction it so desires, in its sole discretion and to limit the quantities of any such product or service that it provides. Any offer for any product or service made on the Platform is void where prohibited.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Akoirah does not offer services or sell products to parties under the age of 18 years. Akoirah reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders and instructions at its sole discretion.

Eligibility

You may use the Platform only if you are an Indian citizen having a valid bank account in India and are competent to enter into a legally binding contract under applicable law.

Akoirah reserves the right to permit or restrict access to the Platform or its services for any person, including non-resident individuals, in accordance with applicable laws, internal policies, and regulatory requirements.

Your Registration Obligations

In consideration of your use of the Platform, you agree to:

• Provide true, accurate, current and complete information about yourself as prompted by the registration form required by the Platform (such information being the “Registration Data”), and
• Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

In addition, if required you fill and sign all forms and documents which form part of your account opening kit, and supply us with all the relevant legal documents and financial information which law requires us to maintain. You warrant and represent that all information that you supply to us is accurate and truthful. You also expressly authorize Akoirah to obtain reports concerning your credit standing and business conduct.

On filling up your details as requested on the Platform at the time of your first purchase of any Product, Your details will be saved for future login purpose.

Notwithstanding the foregoing, we may provide you with access to some parts of the Platform without you registering as a user. In that case, your identification is based on other means of identification that we deem appropriate. You warrant and represent that all information provided for this other means of identification is accurate and truthful. You further agree that such information may be collected and disclosed to us and used in accordance with these Terms and Conditions of Access and Use.

Disapproval of Application

If you provide any information that is untrue, inaccurate, not current or incomplete, or Akoirah has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Akoirah has the right to suspend or terminate your account and refuse any and all current or future use of the Platform (or any portion thereof) without any liability to you.

Account Security

Upon completing the registration process with the Platform, the system will create a unique customer id for you. You are responsible for maintaining the confidentiality of the account and are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Akoirah of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

Termination of Account

Akoirah reserves the right to discontinue, in whole or in part, any portion of the Platform services or programs with or without notice to the Registered Member. This discontinuation may relate to all Registered Members, certain groups of Registered Members, or to certain individual Registered Member.

You agree that Akoirah, in its sole discretion, may terminate your password, Account or your use of the Platform. Akoirah may terminate your Account and remove any content within the Platform for any reason, including, without limitation, if Akoirah, in its sole opinion, believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions of Access and Use. Akoirah may also, in its sole discretion and at any time, discontinue the Platform, or any part thereof, without notice. You may also request Akoirah to terminate your account with us by sending an email to the customer help desk from your registered email id. You agree that any termination of your access to the Platform under any provision of these Terms and Conditions of Access and Use may be affected without prior notice and acknowledge and agree that Akoirah may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or to the Platform. Further, you agree that Akoirah shall not be liable to you or any third-party for any termination of your access to the Service.

Investment Decisions

Akoirah may publish research and opinions on the Platform, for your information. You may not rely on any such information for forming your investment decisions. You acknowledge that Akoirah or the Platform and its officers, directors, employees, agents and affiliates will have no liability with respect to transactions in or for your Account and your investment decisions.

Control & Reporting Systems

• The Platform may, at the decision of Akoirah, cease operations in Product on the system for such an amount of time and for such reasons as it may deem fit in the best interests of the Registered Members and the overall markets. Orders, if any, in violation of an operation cease, will be rejected by the Platform.
• Details of transactions conducted by Registered Members would be updated with the back-office systems of Akoirah on a real time basis. Registered Members can access the reports of their transactions over the Platform. Akoirah may record such additional information about the buying and selling conducted on the Platform as it may consider relevant or necessary for its own use.

Intermediaries

Akoirah may appoint Intermediaries and Distributors who shall assist us in distributing our products to you. Akoirah shall communicate all the transaction details to you directly by means of emails, SMS and any other medium and it is your responsibility to ensure that you receive this communication. When you visit the Platform or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may communicate with you by one or more letters, e-mail, SMS or by posting notices on the Platform. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy all legal requirements that such communications be in writing. Akoirah shall not be responsible to you in the event of default or any wrongful, dishonest, criminal, fraudulent act or wilful misconduct or gross negligence on the part of these Intermediaries. However, you shall immediately inform Akoirah on occurrence of such an event through e-mails/telephone/fax or any other convenient means. The activities of the Intermediaries and its personnel/ representative(s) shall not be construed to be activities of Akoirah.

Force Majeure

In case of inability of Akoirah to make deliveries of the Product due to reasons beyond its control, Akoirah may require that the deliveries be effectuated through specific modes, including through local agents or third-party agency. In such a case, you agree to bear any additional costs and fees necessary for the delivery to be complete.

Fraudulent Transactions

• The Customer should take care not to share their login credentials, mobile wallet details, personal UPI pin or OTP (“Payment Information”) with any third party intentionally or unintentionally. Akoirah never solicits Payment Information over a call or otherwise. Akoirah and/or the relevant Payment Gateway Partner(s) or Akoirah Partners shall not be liable for any fraud due to the sharing of such details.
• In the event that an individual’s Payment Information and/or payment instrument is fraudulently utilised to purchase Product(s) on the Platform (“Fraudulent Transaction”) from Akoirah, then Akoirah may share relevant information of such transaction if the victim approaches Akoirah via proper channels including Akoirah’s customer support number and email (info@akoirah.com), along with supporting documentation from the relevant public authority or Cyber Cell.
• In the event that Akoirah and/or the Akoirah Partner or Payment Gateway Partner(s) have flagged any transaction or Customer’s Account as suspicious as per their internal guidelines, or where it is found that a Customer has utilised Payment Information or a Payment Instrument in an unauthorised or fraudulent manner to purchase Product(s) or undertake any other transaction on the Platform (“Fraudulent User”), Akoirah and/or the Payment Gateway Partner(s) shall be entitled to:
  
  1. request further KYC information or other documentation from the Fraudulent User to verify the flagged transaction;
  2. pending further verification, block such Fraudulent User, and/or freeze any accounts associated with them;
  3. reverse any such Fraudulent Transaction, to the extent possible, including the sale of any Product(s) purchased by such Fraudulent User, at the prevailing rate;
  4. provide information on such Fraudulent User, along with any other transaction details, to the relevant authorities.

In the event of a Fraudulent Transaction as aforesaid, Akoirah shall make a reasonable effort to assist the victim in recovering their funds, subject to supporting evidence and documentation being provided upon request. Akoirah shall be entitled to transfer the victim’s funds, less any payment gateway charges that are not refunded to the relevant Payment Gateway Partner(s).

However, it is clarified that Akoirah shall not be obligated to reverse any transaction where the Fraudulent User has already sold the Product(s) purchased through the Fraudulent Transaction and received the funds against such sale; or where the Fraudulent User has chosen to take delivery of the Product(s) so purchased. In this event, Akoirah shall, to the best of its ability, provide any information on the Fraudulent User, including the bank account or mobile wallet account to which funds have been settled, or the physical address to which the Product(s) has been delivered, to the victim or the relevant authorities.

Suspension/Closure of Customer’s Account

• Akoirah may, at its discretion, suspend any Customer’s Account or log in details, if there appears to be a fraudulent or suspicious activity in the Customer’s Account. If Akoirah is of the opinion that any Customer is involved in any unlawful activity or the Customer’s Account is used for any unlawful purpose, Akoirah shall have the right to take all actions available to it, including black-listing or blocking such Customer from using the Services on its Platform or blocking the said Customer’s access to the Services through the Platform or intimating the relevant authorities of such unlawful activities.
• Akoirah shall not be held liable/responsible, in any manner whatsoever, for any loss/liability arising out of or relating to any technical failure/issue in Platform and/or acts/omission not attributable to it.
• The Customer shall inform immediately, in any case no later than 10 (Ten) Business Days of the transaction, of any irregularities or discrepancies that may exist in the Customer Account, failing which it shall be deemed that there is no error or discrepancy in the said Account. All records maintained by Akoirah, in electronic or documentary form of the instructions of the Customer and such other details (including but not limited to payments made or received) pursuant to the Terms and Conditions, shall as against the Customer, be deemed to be conclusive evidence of such instructions.

ADDITIONAL TERMS – COMMERCIAL, KYC, PAYMENT, RETURNS, EXCHANGE AND BUYBACK

1. Pricing Consistency

The prices of Products displayed on the Platform (https://www.akoirah.com/) and at Akoirah retail stores shall be uniform and consistent, unless otherwise expressly specified. All prices are subject to applicable taxes and charges.

2. Order Acceptance and Contract Formation

All orders placed by a Customer constitute an offer to purchase. Acceptance of such offer shall occur only upon confirmation of the order by Akoirah and/or dispatch of the Product. Akoirah reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases involving pricing errors, stock unavailability, or suspected fraudulent transactions.

3. KYC Requirements
For any purchase, completion of Know Your Customer (KYC) formalities shall be mandatory for purchases exceeding the thresholds prescribed under applicable laws, including the Income Tax Act, 1961, as amended from time to time. Notwithstanding the above, Akoirah reserves the right to request additional documentation and to require completion of KYC for any transaction, and to reject, suspend, or cancel any transaction or order in case of incomplete, inaccurate, or non-compliant KYC.

4. Payment Conditions

All payments must be made by the Customer from their own bank account or payment instrument. Third-party payments are strictly prohibited. Akoirah reserves the right to reject or cancel any transaction that does not comply with this requirement.

5. Refund Source

In the event of any refund, the amount shall be credited only to the same bank account or payment source from which the original transaction was made. No third-party transfers shall be permitted.

6. Quality Check and Condition of Product

All returns, exchanges, and buyback requests shall be subject to a mandatory quality check by Akoirah. The quality check shall be completed within 2 (two) working days from the date of receipt or submission of the Product. The Product must be returned in its original condition, including all certificates, invoices, packaging, and without any damage, alteration, wear and tear, or tampering. Akoirah reserves the right to reject any request where the Product does not meet its quality standards. The decision of Akoirah pursuant to such quality check shall be final and binding.

7. Shipping and Delivery

Akoirah shall arrange for delivery of Products to the address provided by the Customer at the time of placing the order.

• The estimated delivery timelines shall be communicated to the Customer at the time of order confirmation. Such timelines are indicative and may vary depending on product availability, location, logistics constraints, or other factors beyond Akoirah’s control.
• Shipping charges, if any, shall be specified at the time of checkout and shall be borne by the Customer unless otherwise expressly stated.
• The Customer shall ensure that accurate and complete delivery details are provided. Akoirah shall not be liable for any delay or non-delivery arising due to incorrect or incomplete information provided by the Customer.
• Delivery shall be deemed completed once the Product is delivered to the address provided by the Customer or received by any person at such address.
• The risk and title in the Product shall pass to the Customer upon delivery.
• Akoirah shall not be liable for any delay in delivery caused due to events beyond its reasonable control, including but not limited to Force Majeure Events.

8. Exchange and Buyback

All Products purchased from Akoirah, whether through the Platform or from physical retail stores, shall be eligible for exchange and buyback, subject to the terms set out herein and any other applicable policies of Akoirah. However, exchange and buyback requests shall be processed only through Akoirah’s physical retail stores, and shall not be facilitated through the Platform.

All exchange and buyback requests shall be subject to: Submission of the Product at an Akoirah retail store; Mandatory quality check, to be completed within 2 (two) working days from the date of submission of the Product; The Product being in acceptable condition, including original packaging, certificates, invoice, and without any damage, alteration, wear and tear, or tampering.

The applicable exchange or buyback value shall be determined based on prevailing market conditions, applicable deductions, and Akoirah’s internal policies in force at the time of such request. Akoirah reserves the right to reject any exchange or buyback request if the Product does not meet the prescribed quality standards, and the decision of Akoirah in this regard shall be final and binding.

9. Return and Refund

For Products purchased through the Platform:

• Customers may initiate a return request within 15 (fifteen) days from the date of receipt of the Product.
• The Customer shall bear all shipping and logistics costs for returning the Product.
• The Customer shall be responsible for ensuring safe return of the Product to Akoirah.
• All returns shall be subject to successful completion of the quality check.

10. Refund Processing

Upon successful quality check and approval:

• Refunds shall be processed within a reasonable period, subject to banking timelines;
• The refund amount shall be credited only to the same bank account or payment source that was used by the Customer at the time of the original purchase;
• Akoirah shall not be liable for delays caused by banking systems, payment gateways, or external factors beyond its control.

11. Right to Reject / Cancel Transactions

Without prejudice to other rights, Akoirah reserves the right to:

• Reject or cancel any order;
• Refuse returns, exchanges, or buyback requests;
• Suspend or block accounts

in cases including but not limited to: suspected fraud or misuse, violation of these Terms, non-compliance with KYC or payment conditions.

12. Product Disclaimer (Jewellery Specific)

• Product images are for illustrative purposes only and may vary in colour, size, finish, or appearance.
• Minor variations in weight, dimensions, and design may occur and shall not be considered defects.
• Prices and valuations of Products are influenced by prevailing market conditions, including fluctuations in gold and diamond rates, and are subject to change accordingly.

13. No Third-Party Rights
Only the Customer who has placed the order shall be entitled to any rights, claims, or benefits under these Terms. No third party shall have any rights or claims in relation to any transaction.
